Terms and Conditions
By using this website and registering for courses offered by Atlantic Coast CPR & AED Training LLC (“Company,” “we,” “us,” or “our”), you agree to the following terms and conditions (“Terms”):
1. Website Use
· The content on this website, including text, images, logos, and downloadable
materials, is the property of Atlantic Coast CPR & AED Training LLC and is
protected by copyright.
· You may not copy, reproduce, distribute, or otherwise use any website content
without the Company’s written permission.
· The Company makes reasonable efforts to ensure website content is accurate,
but does not guarantee that all information is current or error-free.
2. Registration & Payment
· Course registration is confirmed only after full payment is received.
· Payment may be made via approved online methods.
· All course fees are non-transferable unless explicitly approved by the Company.
3. Cancellation & Refunds
Cancellations made 96 hours or more before the scheduled class receive a full refund
or a one-time complimentary reschedule. Cancellations within 96 hours or no-shows
are non-refundable. If the Company cancels a class, participants may choose a full
refund or transfer to another session. All course cancellations, refunds, and rescheduling requests are governed by our Refund & No-Show Policy, which is available on our website and is hereby incorporated into these Terms by reference.
4. Course Exams & Certification
· Exams follow American Heart Association (AHA) guidelines.
· Exam materials are proprietary and owned by the AHA; copying or sharing is
prohibited.
· Certification is issued electronically upon successful completion of all course
requirements.
5. Attendance & Conduct
· Full attendance and completion of all course components are required to receive
certification.
· Participants must follow instructor directions and conduct themselves
professionally.
6. Online / Blended Learning
· Online modules must be completed prior to in-person skills sessions.
· Certificate of completion for the online portion must be provided to the instructor
prior to starting the skills session.
· Certification is issued only after both online and in-person components are
completed.
7. Liability Assumption of Risk and Release of Liability
Participation in courses may involve physical activity, including CPR and First Aid
practice. Participants assume responsibility for their own safety. The Company is not
liable for injuries except in cases of gross negligence by the Company or instructor.
You acknowledge that participation in CPR, AED, and First Aid Training involves
physical activity, including but not limited to, kneeling, performing chest
compressions, and practicing skills on manikins and with other participants. You
voluntarily and expressly agree to accept and assume all risks of injury, illness,
or property damage arising out of or related to your participation in any course
offered by the Company.
In consideration for being permitted to participate in the course, you hereby
forever release, waive, and discharge the Company, its members, managers,
instructors, employees, and agents from any and all claims, demands, damages,
actions, or causes of action, whether in law or equity, arising from or related to
any loss, damage, or injury, including death, to your person or property that may
be sustained, whether caused by the ordinary negligence of the Company or its
representatives, or otherwise.
8. Website Links & Third Parties
· This website may contain links to third-party sites. The Company is not
responsible for the content, privacy practices, or accuracy of these external sites.
9. Policy Acknowledgment
By using this website and registering for courses, you acknowledge and agree to all
Company policies, including cancellation, refund, and exam integrity policies.
By completing your registration and submitting payment, you affirmatively acknowledge,
represent, and warrant that you have read, understood, and agree to be legally bound
by these Terms & Conditions and all policies incorporated herein by reference, including
the Privacy Policy and the Refund & No-Show Policy.
10. Changes to Terms
Atlantic Coast CPR & AED Training LLC reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on the website and will apply to all users and course registrants. Your continued use of the website or courses after such
changes are posted constitutes your acceptance of the new Terms.
11. Governing Law and Venue
These Terms and Conditions and any dispute arising out of or related to them shall be
governed by and construed in accordance with the laws of the State of Delaware,
without regard to its conflict of law principles. You irrevocably agree that any legal action
or proceeding arising out of or relating to these Terms shall be brought exclusively in the
state or federal courts located in Sussex County, Delaware.
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court
of competent jurisdiction, such finding shall not affect the validity or enforceability of any
other provision, which shall remain in full force and effect.
13. Entire Agreement
These Terms, together with the Privacy Policy and Refund & No-Show Policy
incorporated herein, constitute the entire agreement between you and the Company
with respect to your use of the website and registration for courses, and supersede all
prior or contemporaneous communications and proposals, whether electronic, oral, or
written.
14. Dispute Resolution
In the event of a dispute arising from these Terms, the parties agree to first attempt to
resolve the matter informally by contacting the Company directly by email at
